2. Interpretation
2.1 "the Council means Thanet District Council of P O Box 9 Cecil Street Margate Kent CT9 1XZ.
2.2 “the Licensee” means the person specified in Clause 1 above being the Licensee. (The Licence will be granted to one named person only.)
2.3 “Commencement Date” means the date on which this Licence is granted by the Council or such later date as shall be agreed between the parties in writing
2.4 “Conditions and Regulations” means the Conditions and Regulations subject to which the grant of this Licence is made and a copy of which has been supplied to the Licensee and any amendment or addition thereto which may be made from time to time and notified to the Licensee. The Conditions and Regulations shall apply to and be deemed to form part of this Licence.
2.5 “Container” means the Container described above.
2.6 “Container Space” means the Container Space used by the Licensee in accordance with the terms of this Licence specified in Clause 1 above.
2.7 “Licence Fee” means the sum payable in advance on the Payment Date for the rights hereby granted (or other periodic sum payable in advance for such weekly, monthly, etc. use as agreed by the Council). The amount of the Licence Fee shall be determined from time to time by the Council and notified to the Licensee.
2.8 “Licence Period” means the period from and including the Commencement Date and continues until such time the Licence Period ceases upon its termination under the terms of this Licence.
2.9 “Payment Date” means the Commencement Date.
3. Grant of Licence
3.1 The Council agrees to grant the Licensee a Licence to use the Container during the Licence Period upon and subject to the Conditions and Regulations.
3.2 The Council reserves the right (at its absolute discretion) to relocate the Licensee to an alternative Container within the Container Yard by giving to the Licensee not less than 7 days’ prior written notice (or without notice in cases of emergency).
3.3 Throughout the duration of the Licence the Licensees right to gain access to/egress from the Container Yard shall be limited to the opening hours permitted by the Harbour Master and any access to the Container Yard outside these permitted hours for the purposes of accessing the Container to which this Licence operates will be at the absolute discretion and supervision of the Harbour Master or such person duly authorised by the Harbour Master.
I apply for a licence for a Council owned container in the Container Yard for the Licence Period mentioned below and in consideration of the Licence Fee mentioned below. I understand that if granted, the Licence will be made subject to the Conditions and Regulations referred to below and agree and undertake with the Council to observe and perform the Conditions and Regulations.
